The “Homosexual Panic Defense” is an argument commonly used by lawyers trying to lessen their straight client’s manslaughter sentence for the murder of a gay, or otherwise queer, victim. It involves arguing that the murder is not really as big a deal as others because the mere presence of a homosexual, especially if they’re perceived to be making sexual advances, is sometimes enough to send the murderer into a psychotic state that they can’t be responsible for and that therefore, these cases don’t involve intent and deserve shorter sentences. It’s the same sort of argument that’s sometimes used when women, you know, piss off their husbands or boyfriends and are, therefore, obviously just asking for it. By this (non)logic, these victims are more deserving of hate and violence than others.

Which is a big load of shit. So, support All Our Rights– an LGBT group dedicated to getting rid of this sad excuse for a “defense” that’s so much a part of our “justice” system- and other groups like it.
